Terms of Service

1 Definitions

Throughout this document, the following terms carry the defined meanings:

• “Sima”, “we”, or “the service”: the Sima application with identifier ir.sima.aiphotostudio, the sima-app.ir website, and all versions, flavors, APIs and ancillary services thereof.
• “User” or “you”: any natural or legal person who uses the Sima service in any manner, including registered users, guest users, and website visitors.
• “Account”: the profile created with a verified Iranian mobile number via one-time password (OTP).
• “Diamond”: the internal, virtual unit of credit inside Sima — a computational tool, not currency, cryptocurrency, security, or financial asset. Diamonds are not convertible to cash, not transferable between accounts, and not refundable.
• “Filter / tool”: any of Sima's image-processing capabilities, whether general-purpose or season-specific.
• “Generation” or “job”: a single image-processing request you initiate by final confirmation and diamond deduction.
• “Distribution channels”: the routes through which you reach Sima — Cafebazaar, Myket, direct APK install, and the web.

2 Acceptance

Installing the application, launching it for the first time, creating an account, using it as a guest, visiting the website, or any other interaction with the service constitutes explicit, informed and irrevocable acceptance of this document.

Acceptance means that:

• You have read and understood every clause.
• You are an adult with the legal capacity to accept this contract.
• This acceptance constitutes your electronic signature.
• “I didn't read it” or “I didn't understand it” will not be accepted as a defense by any authority.

3 User eligibility

To use Sima you represent and warrant that:

• You are at least 18 years old. Users between 13 and 17 may use the service only under the supervision and full responsibility of a legal guardian, who is then bound by every provision of this document.
• Users under 13 are strictly prohibited from using the service.
• You are not under sanctions, court order, or any legal restriction preventing the use of software services.
• The identification details (especially the mobile number) belong to you and you do not impersonate anyone else.

Breach of any of these conditions results in deletion of the account without notice, without refund, and without right of appeal.

4 User account

4.1 Account responsibility

You alone are responsible for the security of your device, your mobile number, and access to your SIM card. Any activity on your account — with or without your awareness — is attributed to your account.

4.2 Single-device session

Sign-in to Sima is active on one device at a time. Signing in on a new device automatically terminates the previous session.

4.3 No account sharing

The account is personal and non-transferable. Selling, leasing, transferring, or sharing the account with another person is strictly prohibited and results in immediate suspension.

4.4 Multiple accounts

Creating more than one account with multiple numbers to abuse sign-up, referral, or other promotional bonuses is prohibited. If detected, all related accounts and their diamonds will be forfeited without refund.

5 Distribution channels

Sima is currently delivered to users through four channels, and this document applies uniformly to all of them:

1. Cafebazaar: Android build with in-app billing via Poolakey.
2. Myket: Android build with in-app billing via Myket IAB.
3. Direct install (Direct APK): downloaded from the official website sima-app.ir, with diamond top-up through web payment gateways.
4. Web: the web build hosted on sima-app.ir and its subdomains.

6 Intellectual property

6.1 Sima's assets

All intellectual-property rights in the application, source code, the name “Sima”, the logo, icons, design, user interface, textual content, filters, algorithms, and every work created by us belong to the Sima team and are protected by applicable intellectual-property law.

6.2 Scope of the user's license

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the app for personal, non-commercial purposes. This license does not include:

• Copying, reproducing, publishing, leasing, or selling the app or any part of it.
• Reverse engineering, decompiling, modifying code, or circumventing security mechanisms.
• Using the API, endpoints, or server resources through automation, scripts, or bots without our explicit written permission.
• Using the “Sima” name, logo, or brand to build a similar product or cause confusion in the user's mind.

6.3 Generated outputs

Subject to the input belonging to you and the provisions of this document being respected, you have the right to personal use, sharing, and even commercial use of the images you generate with Sima's filters. This right is conditional on:

• Your input not infringing any third-party right (it must belong to you, or be uploaded with the explicit permission of its rightful owner).
• The output not being used for illegal purposes, defamation, slander, spreading false information, or producing content harmful to others.
• You not claiming the output is purely your own artistic work (without acknowledging the role of AI).

We do not claim ownership of your input, but we do retain the technical right to process the image temporarily and to store it briefly for the purpose of delivering the service.

7 User conduct — prohibited uses

By using Sima you undertake not to use the service for any of the following purposes:

• Uploading or producing immoral images, nudity, pornography, or any content that conflicts with the laws of the Islamic Republic of Iran.
• Producing content containing graphic violence, torture, harassment, or the promotion of suicide.
• Making deepfakes or altering people's likeness without their consent — including celebrities, political or religious figures, and your own acquaintances.
• Insults, defamation, slander, character assassination, or incitement to ethnic, religious, gender, racial, or political hatred.
• Producing images involving children in inappropriate ways — sexual, violent, or threatening. Detection of such content will result in immediate referral to judicial authorities.
• Producing content for fraud, document forgery, identity forgery, official document, banknote, or cheque counterfeiting, or any document that could be used to deceive others.
• Attempting to disrupt Sima's servers via DoS, code injection, or any other technical means.
• Automated content extraction (web scraping), gaming bonus systems, or using bots or emulator devices to generate bulk requests.
• Circumventing the payment system, using stolen cards, charging back after receiving the service (chargeback fraud), or any other financial abuse.
• Any use that violates Iranian criminal, civil, commercial, or data laws, or those of the user's country of residence.

8 User content & processing consent

8.1 User warranty

By uploading any image, you warrant that:

• The image belongs to you, or you have explicit, demonstrable consent from its rightful owner.
• The image infringes no third-party right (intellectual property, personality, or privacy).
• The image does not fall within any of the prohibitions of §7.
• The age of persons depicted in the image complies with the laws of their country of residence.

8.2 Processing license

By uploading an image, you grant Sima a non-exclusive, royalty-free, worldwide, temporary license to process, briefly store, route to AI models, and display the output back to you. This license terminates when the image is deleted or when your account is deleted.

8.3 Right to reject or remove content

We reserve the right, without notice and without obligation to explain, to remove, reject, or block any content we deem suspicious, in breach of this document, or unlawful. This decision is final and not subject to appeal.

8.4 AI false-positives

The AI models may, in some cases, mistakenly reject permitted content (false-positive moderation) or accept inappropriate content. This is a natural property of the technology and we make no commitment regarding 100% accuracy of the detection system.

9 Diamonds & payments

9.1 Nature of diamonds

A “diamond” is an internal computational unit designed for using Sima's services. Diamonds:

• Are not currency, fiat money, cryptocurrency, or security.
• Are not withdrawable, convertible to cash, transferable to a bank account, or transferable to another account.
• Have a value defined solely for calculating internal service charges and have no financial value outside the system.
• Have no explicit expiry date, but are forfeited upon account deletion, permanent suspension, or service termination.

9.2 Top-up packages

The price of top-up packages and bonus amounts is displayed on the “Wallet top-up” screen inside the app. These figures may be updated without notice. Purchases are based on the price displayed at the moment of final confirmation.

9.3 Deduction rate

The diamond cost of each generation is shown explicitly before final confirmation. By tapping confirm, you consent to the deduction of the specified amount from your diamond wallet.

9.4 Hold and Capture

At the start of a generation, the diamond amount is temporarily held. On success, the final amount is captured; otherwise the hold is released. Any difference between the held and captured amount (due to conservative estimation) is returned to your wallet in your favor.

9.5 Store payment errors

If, during a diamond purchase via Cafebazaar, Myket, or a web gateway, the amount is deducted from you but diamonds are not credited, please wait up to 72 hours for the system to auto-reconcile. If unresolved, open a support ticket in-app or email support@sima-app.ir with the store transaction number.

9.6 Price fluctuation

The diamond cost per filter may be updated to reflect FX rate movements, AI model price changes, or Sima's pricing decisions. These changes do not affect diamonds already in your wallet, but apply to subsequent generations.

10 No refunds, no conversion

10.1 Diamond package purchases

Purchases of diamond packages are final, definitive and irrevocable. As soon as diamonds are credited to your wallet, the purchase is considered complete and:

• Refund to your bank account is not possible.
• Conversion of diamonds to cash, gift cards, or off-platform credit is not possible.
• Transfer of diamonds to another account is not possible.
• Buyer's remorse, change of mind, or non-use is not a valid reason for refund.

10.2 Diamond consumption for a generation

Once you confirm a generation and diamonds are deducted, the output belongs to you — whether you are satisfied with it or not. Dissatisfaction with the AI's output quality is not grounds for a diamond refund.

AI is a probabilistic tool; results can vary from one run to the next. Quality depends on multiple factors that lie outside our full control, including the input quality, lighting, angle, resolution, the model's behavior, and the internal prompt.

10.3 Exceptional refunds

In two specific scenarios, the consumed diamonds are automatically returned to your wallet:

• A complete technical failure where the system produces no output at all.
• All AI models — including fallbacks — fail after exhausting every attempt.

In these cases, no separate action is required from you; the system itself returns the diamonds, and the event is logged in “Transaction history” with the status “refunded”.

10.4 Store refund policies

Any refund request at the store level (Cafebazaar or Myket) is governed solely by that store's own policy and lies outside our control. If a store approves a refund, the corresponding diamonds will be deducted from your wallet, and if they have been spent, we reserve the right to pursue the matter legally.

11 Service provided "as-is"

This means that:

• We make no commitment that the service will be available, free of interruptions, or that any specific feature will remain enabled.
• The service may be stopped, suspended, changed, or removed at any time without prior notice.
• Filters, tools, and features may be added, removed, or modified.
• The quality, speed, or accuracy of AI output may change over time.

12 Disclaimer of warranties

To the maximum extent permitted by law, Sima provides no warranty, express or implied, regarding:

• Fitness of the service for your particular purpose.
• Merchantability, accuracy, completeness, or reliability of the output.
• Non-infringement of third-party rights in generated outputs.
• Compatibility of the app with every device, Android version, or configuration.
• Freedom from bugs, defects, vulnerabilities, or errors.
• Full protection against intrusion, data leakage, or cyberattack.
• Absence of interruption, latency, or temporary failure.

You knowingly accept these limitations by using the service.

13 Limitation of liability

• Direct, indirect, consequential, punitive, or incidental damages arising from use of or inability to use the service.
• Loss of data, photos, diamonds, account, or history for any reason.
• AI-generated content that you or any third party considers unpleasant, inaccurate, harassing, offensive, or misleading.
• Your use of the output for purposes that cause you financial, professional, reputational, psychological, or legal harm.
• Latency, interruption, or disruption caused by network issues, stores, gateways, model providers, or national infrastructure.
• Decisions you make based on Sima's outputs.
• Unlawful acts of third parties causing you damage through the Sima system (hacking, fraud, …).

In any case and where legal liability is established, Sima's maximum financial obligation per user is limited to the amount that user has paid to Sima for diamond packages during the previous 90 days, and no greater amount may be claimed under any theory.

14 Indemnification

You undertake to hold Sima harmless from, and to compensate Sima for, any claim, complaint, lawsuit, or demand by a third party or authority against Sima arising from or related to your behavior, content, breach, or use of the service. This commitment includes:

• Attorney and litigation costs.
• Damages awarded by a court of competent jurisdiction.
• Administrative and legal pursuit costs.
• Reputational or brand harm to Sima.

This obligation survives termination of your account and remains enforceable thereafter.

15 Force majeure

Sima bears no liability for non-performance, delay, or reduced quality of service caused by events outside our reasonable control, including (but not limited to):

• Power, internet, or national infrastructure outages.
• Outage, sanction, or policy change at AI model providers.
• Outage or policy change at Cafebazaar or Myket.
• Outage of banking or online payment gateways.
• Large-scale cyberattacks, DDoS, or intrusion.
• Legal changes, judicial orders, filtering, or shutdown directives.
• Strikes, protests, unrest, war, or military action.
• Natural disasters, earthquakes, floods, fires, epidemics.
• Other unforeseeable events outside our control.

In such cases, unspent diamonds remain in your wallet until the service is restored, but no compensation, refund, or extra diamonds are owed for the delay.

16 Suspension & termination

16.1 Our right

We reserve the right, at any time, with or without notice, with or without stated reason, to temporarily suspend or permanently terminate your access to all or part of the service. This right applies in particular when:

• You breach any provision of this document.
• Your behavior is suspicious of abuse, fraud, or unusual activity.
• There are repeated or strong reports from other users, authorities, or stores.
• A lawful request is received from competent authorities.
• You breach the rules of the store distributing the build (Cafebazaar / Myket).

16.2 Consequences of termination

Upon account termination:

• Your access to the app, gallery, and history ends.
• Remaining diamonds are forfeited and are not refundable or convertible.
• Your images are deleted on their respective retention schedules.
• Financial and legal logs are retained as required by law.

16.3 Termination by the user

You may terminate use at any time by uninstalling the app and requesting account deletion (per §12 of the Privacy Policy). User-initiated termination creates no right of refund or compensation.

17 Changes to these terms

We reserve the right to change, amend, add to, or remove any portion of this document at any time at our sole discretion. Material changes will be notified via one or more of:

• An in-app notice on the next launch.
• An update to the “Last updated” date at the top of this document.
• An announcement on sima-app.ir for substantial changes.

18 Governing law & dispute resolution

18.1 Governing law

This document is governed by the laws of the Islamic Republic of Iran. Any dispute concerning the interpretation, performance, or breach of this document will be reviewed and resolved under Iranian law.

18.2 Jurisdiction

In case of dispute, the judicial authorities of the city of Tehran have exclusive jurisdiction, unless mandatory law provides otherwise.

18.3 Mandatory pre-litigation negotiation

Before any judicial action, the parties undertake to pursue the matter in writing and in good faith for at least 30 working days via legal@sima-app.ir.

18.4 Limitation period

Any claim or action arising from this document must be filed within at most one year from the date the issue arises. Otherwise the right to file is lost.

19 Miscellaneous

19.1 Severability

If a competent authority deems one of the clauses unenforceable, that clause will be interpreted as close to its lawful meaning as possible, and the other clauses remain valid and binding.

19.2 No waiver

Failure by Sima to enforce a right in a particular instance does not constitute a permanent waiver of that right. We may enforce it at any time in the future.

19.3 Entire agreement

This document, together with the Privacy Policy, constitutes the entire agreement between you and Sima, superseding all prior oral or written communications, agreements, or promises.

19.4 Authoritative language

This document is published in Persian and English. In case of any discrepancy between language versions, the Persian version is the authoritative reference.

19.5 No assignment

You may not assign your rights and obligations under this document to another person. We may assign our rights and obligations to a successor or acquirer of the business.

19.6 Relation to the Privacy Policy

The “Privacy Policy” is an integral part of this agreement and must be read and accepted alongside this document.

21 Deepfake & likeness of persons

Given the sensitive nature of AI face-processing technology, specific rules apply to the use of images depicting people:

21.1 Your own image

You may upload your own face. In that case, full responsibility rests with you, including decisions about retention, sharing, or publication of the output.

21.2 Other people's images

Uploading another person's image is permitted only with that person's explicit and demonstrable consent. We assume that consent by default and, in case of complaint, full liability falls on you. The burden of proving consent is yours.

21.3 Celebrities and public figures

Producing images of the identifiable face of celebrities (politicians, artists, athletes, clerics, religious figures, …) is strictly prohibited, even for artistic, satirical, or non-commercial purposes. This prohibition includes:

• Placing a public figure's face in a fabricated scene.
• Forging speech, behavior, or a scene attributed to a public figure.
• Any image that may cause the viewer to confuse it with a real one.

21.4 Deceased persons

Producing “restoration” or “revival” images of deceased persons is permitted only with the written permission of the lawful heirs. The burden of proving such permission rests with you.

21.5 AI-origin disclosure

When publishing Sima outputs — especially those featuring faces — you are strongly advised to disclose the AI-generated nature of the image (as text, label, or personal watermark). Failing to disclose and creating ambiguity for the viewer may fall within the scope of “publishing false information”, and the liability is yours.

22 Class-action waiver

By accepting this document, you explicitly declare that:

• You will pursue any legal action against Sima individually.
• You waive participation in any class action, representative action, or coalition with other users for the purpose of collective claims.
• The judicial authority shall not have the power to consolidate cases in such circumstances.

This waiver is voluntary and informed and constitutes one of the fundamental conditions of using the service.

23 Beta features

From time to time, filters, tools, or capabilities may be released on a trial basis. Such capabilities are labeled “Beta”, “Experimental”, or “Preview”. Regarding these capabilities:

• They may be removed or modified at any time without notice.
• Their quality and stability are not guaranteed.
• Diamonds spent on them are treated the same as any other filter; if a generation fails, the standard refund rules apply.
• We make no commitment to promote them to a stable release.

24 App updates & compatibility

24.1 Optional updates

We update the app continuously. We recommend always installing the latest version.

24.2 Mandatory updates

For security reasons or substantial changes, an update may be made mandatory. In such cases, the old version becomes unusable until you upgrade to the latest release.

24.3 Old versions

We make no commitment to support old versions of the app, old Android versions, or deprecated devices. The minimum supported Android version is stated on the app's store page and may increase over time.

24.4 Changes or removal of features

We reserve the right, at any time, without prior notice, to change or remove existing filters, tools, top-up packages, or capabilities. Such changes include cost, name, quality, or operational rules.

25 API, scripts & bots

Any access to Sima's server through a route other than the official app or official website is prohibited, including (but not limited to):

• Direct use of internal APIs.
• Building a third-party app that uses Sima's APIs.
• Running bots, scripts, headless browsers, or automation tools.
• Manipulating network traffic, man-in-the-middle techniques, or routing requests through a proxy to bypass restrictions.
• Using Android emulators to spawn multiple virtual devices.

If detected, the account is immediately suspended and its diamonds forfeited. In serious cases, legal action will be taken for infringement of intellectual-property rights and unauthorized computer-system access.

26 Discovered content, recommendations & suggested filters

In the “What's New” tab and other sections, filters and topics are suggested to you. These recommendations are based on internal algorithms and:

• Carry no guarantee of quality, taste alignment, or specific suitability.
• A filter suggestion is not a personal recommendation to use; the final decision is yours.
• Seasonal or promotional content may appear in these sections.
• We make no commitment that all users see the same content; the display may be personalized by region or by platform.

27 Notices & communications

27.1 How we notify you

We reserve the right to deliver any notice, communication, warning, or announcement to you through any of the following channels:

• SMS to the registered mobile number.
• An in-app banner, dialog, or notification.
• Email, if you have registered one.
• Posting on sima-app.ir.

Each of these methods alone constitutes official notice; you may not claim non-receipt.

27.2 How you notify Sima

Any official notice, warning, or formal request from you to Sima must be sent to legal@sima-app.ir. Sending to other channels (social networks, messengers, personal accounts, or the day-to-day support ticket system) is not accepted for official notice. The in-app ticket system is for technical and user support only; legal matters cannot be pursued through it.

28 Abuse reporting & takedown

If you are the holder of an intellectual-property right or a personality right and believe that content in Sima infringes your rights, you may submit a takedown request. The request must include:

1. Your full identity (name, contact number, email).
2. A precise description of the content and its location (e.g., job ID or transaction number).
3. Proof of the right you assert (ownership document, court order, …).
4. A formal statement, under your legal responsibility, attesting to the truth of the claim.

Requests are reviewed within 14 working days. We reserve the right to reject, accept, or request further clarification. Frivolous or harassing claims are subject to legal pursuit.

Submit to legal@sima-app.ir with the subject “Content takedown request”.

29 Taxes, duties & fees

The amounts displayed on the top-up screen are inclusive of all lawful taxes and duties, unless explicitly stated otherwise. If Iranian tax or duty laws change, package prices may be adjusted accordingly.

Store fees (Cafebazaar, Myket) and banking gateway fees (on the web) are included in the final price. If you are a business user and require an official invoice, contact legal@sima-app.ir.

30 Outages, sanctions & restricted access

Your right to use Sima may be restricted or terminated if you fall into any of the following scenarios:

• The country or region from which you connect is subject to international sanctions on AI services.
• Sima's domain or server is filtered and you cannot reach it through the standard route.
• Infrastructure services (AI models) have restricted access for Iranian users.

In none of these cases does Sima bear any liability for your inability to access the service or the diamonds in your account. No compensation or refund is owed for restricted access.

The use of VPN, DPI bypass, or other circumvention methods to access the service may, under the laws of your country of residence, be unlawful, and the responsibility is entirely yours.

31 Third-party beneficiaries

This document does not create any rights for third parties; that is, no person other than the direct parties to this contract (you and Sima) may bring a claim or assert a right under it.

Exception: cloud-infrastructure providers, app stores (Cafebazaar, Myket), and AI-model providers act as “limited third-party beneficiaries” and may invoke the no-liability clauses of this document in their own defense, to the extent the user's claim relates to their services.

32 Electronic acceptance & digital signature

By performing any of the following acts, you declare your informed and binding acceptance of this document:

1. Installing the app and opening it for the first time.
2. Tapping “Agree” or “Continue” on the onboarding, sign-up, or OTP screens.
3. Final confirmation of any generation that deducts diamonds.
4. Buying a top-up package.
5. Entering the sima-app.ir domain and using any part of it.

In accordance with the Electronic Commerce Act of the Islamic Republic of Iran (enacted 2003 / 1382 SH), this acceptance has legal effect equivalent to a handwritten signature. The acceptance log (including date, time, IP, device identifier, and app version) is retained on our servers and, in case of dispute, is admissible as legal evidence.

Defenses such as “I didn't read it”, “I didn't understand”, “I clicked by accident”, or “another person used my device” will not be accepted by any authority.
